1. Acceptance of These Terms
These Terms of Service ("Terms") form a binding agreement between you ("you," "your," "User," "Patient," or "Prescriber") and Spectrum Solutions Rx, LLC, doing business as Genesis Compounding Pharmacy ("Genesis," "we," "us," or "our"). By accessing or using www.genesiscompounding.com (the "Site"), submitting a prescription to us, registering for an account, communicating with our pharmacy team, or accepting a medication dispensed by us, you agree to be bound by these Terms and by our Notice of Privacy Practices. If you do not agree, you must not use the Site or our services.
We may update these Terms at any time. Material changes will be posted on this page with a revised Effective Date. Continued use of the Site or our services after changes are posted constitutes acceptance.
2. Who We Are
Genesis Compounding Pharmacy is a PCAB-accredited 503A compounding pharmacy licensed in all 50 U.S. states. We compound patient-specific medications pursuant to valid prescriptions issued by licensed prescribers, in compliance with:
- Section 503A of the federal Food, Drug, and Cosmetic Act
- USP General Chapters <795>, <797>, and <800>
- The Utah Pharmacy Practice Act and rules of the Utah Division of Professional Licensing (DOPL)
- Applicable laws of each state in which we dispense
We are not a registered outsourcing facility under Section 503B, and we do not manufacture, market, or sell drug products in bulk or for office use absent a patient-specific prescription where required by state law.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Site or order from Genesis. Medications ordered for minors must be ordered by a parent or legal guardian. By using our services, you represent that all information you provide is true, accurate, and complete.
4. Nature of Our Services; No Medical Advice
Genesis provides compounding pharmacy services only. We do not provide medical diagnosis, treatment recommendations, or the practice of medicine. Content on the Site — including therapy descriptions, ingredient information, condition pages, patient education materials, and search tools — is provided for general informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
- Always seek the advice of a qualified prescriber regarding any medical condition.
- Never disregard professional medical advice or delay seeking it because of something you read on the Site.
- No prescriber-patient or pharmacist-patient relationship is created by your use of the Site alone.
- Our pharmacists provide medication counseling consistent with state pharmacy practice acts; such counseling is not medical advice.
In an emergency, call 911 or go to the nearest emergency room.
5. Prescriptions and Compounded Medications
5.1 Valid Prescription Required
All compounded medications dispensed by Genesis require a valid prescription from a licensed prescriber with whom the patient has a legitimate prescriber-patient relationship, as required under 503A and applicable state law. We will not dispense without one.
5.2 Patient-Specific Compounding
Compounded preparations are made for an individually identified patient pursuant to that patient's prescription. Compounded drugs are not FDA-approved, are not reviewed by FDA for safety or efficacy, and have not undergone FDA premarket review. Compounding is permitted by federal and state law under defined conditions.
5.3 Clinical Decisions Belong to the Prescriber
The decision to prescribe a compounded medication, including drug selection, strength, dosage form, and route of administration, rests solely with your prescriber. Genesis does not select therapy for patients and does not substitute professional judgment for that of the prescriber.
5.4 Refusal or Modification
Genesis reserves the right, in the exercise of professional pharmacist judgment, to refuse to fill, modify, or cancel any prescription that we believe is incomplete, inappropriate, non-compliant, or otherwise inconsistent with safe pharmacy practice or applicable law.
5.5 Recalls and Quality Events
If we identify a quality issue, recall, or beyond-use date concern affecting your medication, we will use commercially reasonable efforts to notify you and your prescriber and to provide instructions consistent with applicable regulations.
6. Prescriber Accounts and Onboarding
If you access the Site as a prescriber or on behalf of a clinic, telehealth platform, or other healthcare practice ("Prescriber User"), you additionally represent and warrant that:
- You hold an active, unrestricted license, DEA registration (if applicable), and any other credentials required in the state(s) where you prescribe;
- You will only submit prescriptions arising from a legitimate prescriber-patient relationship consistent with the standard of care and applicable telehealth laws;
- The information you submit through onboarding documents, eRx, EMR integrations, or our portal is accurate and current;
- You will promptly notify Genesis of any change in licensure status, disciplinary action, or material change in your practice;
- You will use any Genesis-supplied marketing assets, clinical protocols, or educational materials in compliance with these Terms, FDA promotional rules, state board of pharmacy advertising restrictions, and applicable federal and state anti-kickback laws (including the federal Anti-Kickback Statute and Stark Law where applicable).
Genesis does not pay, and Prescriber Users may not accept, any remuneration in exchange for prescriptions or referrals. Nothing on the Site is intended to induce referrals in violation of law.
7. Ordering, Payment, Shipping, and Returns
7.1 Pricing and Payment
Prices for compounded medications are quoted at the time of dispensing and are subject to change based on ingredient costs, formulation changes, and applicable taxes. Payment is generally due at the time of fill via credit card, debit card, or HSA/FSA card. Many compounded medications are not covered by insurance; you are responsible for charges not reimbursed by any third-party payer.
7.2 Shipping
Genesis ships nationwide, typically delivering within 24–48 hours, using third-party carriers. Title and risk of loss pass to you upon carrier acceptance, except where state law provides otherwise. We take reasonable steps to limit PHI on packaging. Delivery timeframes are estimates and are not guaranteed.
7.3 Compromised or Lost Shipments
If your package is visibly damaged, appears tampered with, or temperature-sensitive medication shows signs of improper storage during transit, do not use the medication. Contact us immediately at 385-279-4420 or pharmacy@genesiscompounding.com.
7.4 Returns
For patient safety and as required by federal and state law, compounded medications are non-returnable and non-refundable once dispensed, except in the limited cases of (a) our dispensing error, (b) a recall, or (c) where state law otherwise requires. Refunds, when permitted, are issued at our discretion to the original payment method.
7.5 Cancellations
You may request cancellation of an order before compounding has begun. Once compounding has started, cancellation may not be possible because the preparation is patient-specific.
8. Telehealth, eRx, and EMR Integrations
We support eRx and EMR integrations and accept prescriptions from telehealth practices. Use of any third-party telehealth platform, EMR, or e-prescribing system is governed by the terms and privacy policies of those third parties. Genesis is not responsible for the availability, accuracy, or security of third-party systems, but we maintain HIPAA-compliant safeguards on our side of the integration. Business Associate Agreements (BAAs) are executed with covered entities and business associates where required.
9. Patient Communications
By providing your phone number or email, you authorize Genesis to contact you regarding your prescriptions, refills, shipping, payment, recalls, and pharmacist counseling by phone (including voicemail), SMS/text, and email. Standard message and data rates may apply. You may request alternative communication methods or opt out of non-essential communications by contacting us; certain communications required to dispense your medication safely cannot be opted out of without affecting your therapy.
10. Site Use, Accounts, and Acceptable Use
You agree to use the Site only for lawful purposes and only as permitted by these Terms. You will not:
- Provide false information or impersonate another person or prescriber;
- Submit a prescription you know or have reason to know is fraudulent, forged, or not for a legitimate medical purpose;
- Use the Site to obtain controlled substances (Genesis does not dispense Schedule I medications and may decline scheduled prescriptions at its discretion);
- Resell, redistribute, or transfer any medication dispensed to you;
- Interfere with, disrupt, scan, probe, or attempt to gain unauthorized access to the Site, our systems, or other users' accounts;
- Upload viruses, malware, or any code intended to harm or disrupt;
- Use the Site to send spam, phishing, or unsolicited marketing;
- Reverse engineer, decompile, or attempt to extract source code from the Site;
- Use any automated means (bots, gatherers) to access the Site or collect user information without our prior written consent.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
11. Intellectual Property
The Site and all content on it — including the "Genesis Compounding" name, logos, formulation descriptions, protocols, patient education materials, prescriber resources, product imagery, software, and design elements — are owned by Spectrum Solutions Rx, LLC or our licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access the Site for personal, non-commercial use, or, for Prescriber Users, for use in connection with the lawful practice of prescribing and patient education. No other rights are granted. Use of our marks, content, or marketing materials without our prior written consent is prohibited.
12. User Submissions and Feedback
If you submit reviews, testimonials, suggestions, or other content to us, you grant Genesis a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, and display such submissions for any lawful business purpose, including marketing, subject to our Notice of Privacy Practices. Do not submit PHI through public-facing forms, social media, or unsecured channels. Use our secure messaging or call 888-500-4711.
13. Third-Party Links and Services
The Site may contain links to third-party websites, services, or resources (including prescriber portals, payment processors, shipping carriers, and educational content). Genesis does not control and is not responsible for third-party sites or their content, products, or practices. Your interactions with third parties are governed by their terms.
14. Privacy and HIPAA
Your protected health information is handled in accordance with our Notice of Privacy Practices, which is incorporated by reference. Other information you provide is handled under our Privacy Policy. You acknowledge that no transmission over the internet can be guaranteed 100% secure, although we maintain administrative, technical, and physical safeguards designed to protect your information.
15. Disclaimers
EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THE SITE AND ALL SERVICES, CONTENT, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
GENESIS DOES NOT WARRANT THAT:
- THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
- INFORMATION ON THE SITE IS COMPLETE, CURRENT, OR ACCURATE FOR ANY PARTICULAR PATIENT'S CIRCUMSTANCES;
- ANY COMPOUNDED MEDICATION WILL PRODUCE A SPECIFIC CLINICAL OUTCOME.
Compounded preparations are not FDA-approved. Individual response to medication varies. Nothing in these Terms is intended to limit liability for personal injury caused by Genesis's negligence, gross negligence, willful misconduct, or violation of the Utah Pharmacy Practice Act, nor to disclaim any warranty that cannot be disclaimed under applicable law.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR CLAIMS ARISING FROM PERSONAL INJURY, DEATH, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR PHARMACIST PROFESSIONAL LIABILITY GOVERNED BY UTAH OR OTHER APPLICABLE LAW, IN NO EVENT WILL GENESIS, SPECTRUM SOLUTIONS RX, LLC, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE (EXCLUDING CLAIMS DESCRIBED IN THE PRECEDING PARAGRAPH) WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO GENESIS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
17. Indemnification
You agree to defend, indemnify, and hold harmless Genesis, Spectrum Solutions Rx, LLC, and our officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Site or any medication; (c) for Prescriber Users, prescriptions you issued or clinical decisions you made; or (d) your violation of any law or third-party right. This section does not apply to claims caused by Genesis's own negligence or misconduct.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. The exclusive venue for any dispute arising from or relating to these Terms or our services will be the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts. Nothing in this section limits your right to file a complaint with the Utah Division of Professional Licensing, any state board of pharmacy, the U.S. Department of Health and Human Services, or any other regulatory authority.
19. Termination
We may suspend or terminate your access to the Site or to our services at any time, with or without notice, for any reason, including suspected fraud, misuse, violation of these Terms, or as required by law. Sections that by their nature should survive termination (including Sections 4, 5, 11, 14–18, and this Section 19) will survive.
20. Reporting Concerns

- Privacy concerns: Contact our Privacy Officer (see Notice of Privacy Practices).
- Suspected fraud or misuse of the Site: pharmacy@genesiscompounding.com.
- FDA MedWatch: You may also report adverse events to FDA at fda.gov/medwatch or 1-800-FDA-1088.
21. Miscellaneous
- Entire Agreement. These Terms, together with the Notice of Privacy Practices, the Privacy Policy, and any prescriber agreements or BAAs, constitute the entire agreement between you and Genesis regarding the Site and our services.
- Severability. If any provision is held unenforceable, the remainder will remain in full force and effect.
- No Waiver. Our failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Headings. Headings are for convenience only and do not affect interpretation.
